Welcome to Campfyre! These Terms of Service ("Terms") govern your access to and use of the Campfyre application and website (the "Service") operated by Freigeist Ventures LLC ("Company," "we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

1. Eligibility

To use Campfyre, you must:

  • Be at least 18 years old, or the age of majority in your jurisdiction
  • Have the authority to enter into these Terms
  • Not be prohibited from using the Service under applicable laws

Children under 13 may use the Service only with verified parental consent and under parental supervision, in accordance with our COPPA Policy.

2. Account Registration

  • You must provide accurate, complete, and current information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately of any unauthorized access to your account.
  • You are responsible for all activities that occur under your account.

3. User Content

Your Content

"User Content" means any content you create, upload, or share through the Service, including voice recordings, text, stories, and profile information.

  • You retain ownership of your User Content.
  • By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and display your User Content solely to provide and improve the Service.
  • You represent that you have all necessary rights to your User Content.

Content Guidelines

You agree not to create or share content that:

  • Is illegal, harmful, threatening, abusive, or harassing
  • Is sexually explicit or pornographic
  • Promotes violence, discrimination, or hatred
  • Infringes on intellectual property rights of others
  • Contains malware or harmful code
  • Is deceptive or fraudulent

We reserve the right to remove any content that violates these guidelines or is otherwise objectionable.

4. AI-Generated Content

Our Service uses artificial intelligence to help create stories, illustrations, and audio.

  • AI-generated content is provided "as is" and may not always be accurate or appropriate.
  • You are responsible for reviewing AI-generated content before sharing or publishing.
  • We do not guarantee that AI-generated content will meet your specific requirements.
  • AI-generated illustrations and voices are for personal, non-commercial use within the Service.

5. Subscriptions and Payments

Subscription Plans

  • Some features of the Service require a paid subscription.
  • Subscription fees are billed in advance on a monthly or annual basis.
  • Prices are subject to change with reasonable notice.

Cancellation and Refunds

  • You may cancel your subscription at any time through your account settings.
  • Cancellation takes effect at the end of the current billing period.
  • We do not provide refunds for partial subscription periods.
  • Refund requests for exceptional circumstances will be reviewed on a case-by-case basis.

Free Trials

We may offer free trials at our discretion. At the end of the trial, you will be automatically charged unless you cancel before the trial ends.

6. Intellectual Property

  • The Service, including its design, features, and content (excluding User Content), is owned by Freigeist Ventures LLC and protected by intellectual property laws.
  • You may not copy, modify, distribute, or create derivative works of our Service without permission.
  • "Campfyre" and our logo are trademarks of Freigeist Ventures LLC.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, secure, or error-free
  • Results obtained from the Service will be accurate or reliable
  • Any errors in the Service will be corrected

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FREIGEIST VENTURES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Service
  • Unauthorized access to or alteration of your data
  • Statements or conduct of any third party on the Service
  • Any other matter relating to the Service

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Freigeist Ventures LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your User Content
  • Your violation of these Terms
  • Your violation of any rights of another party

11. Termination

  • We may terminate or suspend your account immediately, without prior notice, for any violation of these Terms.
  • You may terminate your account at any time by contacting us or through account settings.
  • Upon termination, your right to use the Service will immediately cease.
  • Provisions of these Terms that should survive termination will remain in effect, including ownership, warranty disclaimers, and limitations of liability.

12. Governing Law and Disputes

These Terms shall be governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and Freigeist Ventures LLC regarding the Service.
  • Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.
  • Waiver: Failure to enforce any right or provision does not constitute a waiver.
  • Assignment: You may not assign these Terms without our prior written consent.
